ISSUES

ADMISSIBILITY . A visa applicant must be admissible in ten general, important ways to receive a nonimmigrant visa, including health, financial ability, clean criminal history, immigration history, etc. See Admissibility for more details.

NON-IMMIGRANT INTENT . An H1B Visa applicant is allowed to have ‘dual intent,’ meaning that s/he may intend to enter the United States on a permanent basis even though s/he is making application for this, a temporary visa. This means that a pending permanent resident application is not a problem for this type of visa application. Other H Visas require showing that the applicant does not have "immigrant intent" or does not intend to stay in the U.S. permanently.

WORK AUTHORIZATION/SCHOOL .  Professional Visa holders are eligible to work for their sponsor company only; other employment requires separate application. Family members of H Visa holders may not work but may attend public school in the United States.

DURATION OF AUTHORIZED STAY . Duration of stay varies depending on type of visa.


PERMANENT RESIDENCE . Professionals all have a path to permanent residence.  The length of time it takes and the procedure involved depends on the qualifications and experience going in.
